Practice Review Department

The practice review department works with lawyers to address the issues that impact their law practice such as client service, time management and efficient workflow.   There are two forms of involvement with the Committee, formal and informal, however, the focus remains the same – to encourage the provision of quality service to clients and to develop a more enjoyable and profitable practice.  Informally, lawyers can be involved with the Committee by contacting the department and requesting assistance.  Lawyers are also contacted on the basis of:

• informal or formal complaints,
• reported insurance claims,
• late filing of forms or payment of fees, or
• trust accounting irregularities.

Formally, lawyers are involved with the Committee when their participation is mandated under the jurisdiction of the Legal Profession Act and/or the Rules of the Law Society of Alberta:

• a formal complaint,
• a finding of conduct deserving of penalty (sanction) or,
• a reinstatement application.
These lawyers have a mandatory responsibility to work with the practice review department as outlined in:
• sections 58, 72, and 73 of the Legal Profession Act
• 118 of the Rules of the Law Society of Alberta,

Throughout the practice review process the emphasis is on helping lawyers improve their law practice. The process involves one staff person from the practice review department and a panel of three members of the practice review committee, who are Alberta lawyers. The panel works with the lawyer to discuss their law practice, and help develop and implement a plan that may assist them to improve service and satisfaction.

The panel also provides ongoing monitoring throughout the implementation process, which has several steps that may include:

• assessments of the law practice,
• ongoing evaluation of steps taken, and
• regular meetings with the practice review panel.
