Disbarment - Mr. Brent Frederick Bittner

On October 20, 2008, a Resignation Committee appointed by the Benchers of the Law Society of Alberta granted the application of Brent Frederick Bittner to resign, pursuant to Section 61 of the Legal Profession Act, effective immediately. Mr. Bittner is therefore disbarred. Mr. Bittner resides in Edmonton and practised in Edmonton until his resignation.

Disbarment - Mr. David Eugene Kiester

On November 3, 2008, a Hearing Committee found David Eugene Kiester, who resides in Calgary and practised there until his suspension in August of 2005, guilty of the following citations: that he collected GST and misappropriated the funds to his own personal use, that he collected retainers from clients and misappropriated funds prior to fully earning the retainers, and that he disguised the receipt of income from his practice to avoid a garnishee on his general account.

Suspension - Madeline Wood

On October 28, 2008, a Hearing Committee appointed by the Benchers of the Law Society of Alberta found that the conduct of Madeline Wood, who resides in and practised in Calgary until December 2, 2005, was deserving of sanction in that she failed to respond on a timely basis to the Law Society, and failed to maintain the books and records of her trust account, failed to reconcile her trust accounts, and failed to file Forms T, all as required by the Rules of the Law Society of Alberta.

The Hearing Committee directed that Ms. Wood’s membership be suspended under Section 72(1)(b) of the Legal Profession Act for a period of three months, effective October 28, 2008. Ms. Wood had previously been suspended under Section 63 of the Legal Profession Act on December 2, 2005.
