be a suspension of one year duration, commencing in November 2006. The committee recognized B.'s need to earn a living and support his family. The sanction is not intended to be punitive but rather to express the Law Society's strong disapproval of the conduct.
The hearing committee noted in its report that it "is of the opinion that the Member does not represent a hopeless case and that somewhere in this mix of circumstances, there is a good lawyer to be salvaged."
The following conditions are attached to this suspension:
- That B. will cooperate with the Executive Director and eventual custodian
- Prior to any reinstatement, B. must satisfy the Practice Review Committee that he has resolved his mental health issues such that he can resume practice.
- B. be prohibited from re-entering private practice upon expiry of the suspension without the prior approval of the Practice Review Committee, and
- B. must cooperate fully with the Committee with respect to any conditions or requirements either before or after reinstatement.
The hearing committee "hopes that the |

Member will see the suspension as an opportunity to reflect, get healthy, establish communications with his family and develop a support network."
B. was ordered to pay the actual costs of the hearing when determined, in full prior to reinstatement. (Hearing report issued January 17, 2007).
Reprimand of C.
In November 2006, a Hearing Committee issued a reprimand to C. after finding a breach of undertaking in citation one was conduct deserving of sanction. The second and remaining citation was dismissed.
The Hearing Committee determined that a reprimand was the appropriate sanction as C. is a senior counsel with over 35 years of experience and an unblemished record. The panel determined that C. did not intend to cause any harm, as he thought that obtaining Title Insurance as a solution in a real estate transaction would protect the clients involved. The Hearing Committee found that it did not unilaterally relieve him of his undertaking. None the less, the Hearing Committee found that C. entered into an undertaking for a $15,000 holdback, for which he was bound until it was varied.
The Hearing Committee directed that C. pay one half of the actual costs. The Committee found no need for a Notice to the Profession under Rule 107 in this case. (Hearing report issued January 24, 2007). |
