Dower Consent Schedule to the Standard Form AREA Listing Agreement

The Alberta Real Estate Association (AREA) has recently amended its standard form listing agreement to clarify that where the title is in only one name, the person is legally married and either one of the married couple resided on the property during their marriage, a dower consent must be obtained from the non-titled spouse at the time of the execution of the listing agreement. The consent protects both the registered owner and the industry member by confirming that the non-titled spouse will co-operate with the marketing and sale of the home and also ensures that the charging clause in the listing agreement is enforceable allowing the securing of commissions against the title to the land.

Lawyers are being consulted by non-titled spouses in respect of the execution of this consent. According to AREA, some lawyers are wrongly advising non-titled spouses that such a consent is not required in these circumstances and have on occasion cast aspersions with respect to the realtor who has requested that the dower consent be executed.

This matter is being brought to the attention of the profession in the hope that it will foster better understanding and co-operation between the professions.
