Protocol Marks Milestone with Major Banks

With the Bank of Nova Scotia's announcement in August 2007 that it had approved the Western Conveyancing Protocol for residential mortgage transactions in the west, all five major Canadian banks have now adopted the Protocol for use in Alberta.

Practitioners are reminded, however, that there remain a few smaller institutions who have not yet adopted the protocol. It is important to ensure that instructions from a financial institution specifically allow the completion of a transaction on a protocol basis if it is to be used.

Further, as the use of the protocol has become more universal, there is a tendency to attempt to use it when it is not available in accordance with protocol rules.

Practitioners are reminded to analyze each transaction to ensure that a protocol closing is, in fact, available before attempting to complete a transaction on a protocol basis.
