At the March Convocation of the Benchers, a motion was passed to increase the CPLED tuition fee from $2,035.00 to $2,130.00. A detailed analysis of the proposed fee to cover projected increased cost of the program was conducted by CPLED. This reflects a 4.7% increase.

Mandatory submissions of document registration request forms began on November 15, 2007. The search function for pending registrations will be fully available November 26, 2007. Once the search capability is fully available, as a prudent solicitor completing a Protocol transaction, such a search would generally be considered to be a required action. To the extent that any potential intervening encumbrances are identified by such a search, then the practitioner should make reasonable inquiries and make a prudent decision as to the impact of such a potential intervening encumbrance on the subject transaction. |

Reprimand of C. In July 2007, a hearing panel of the LSA convened to inquire into the conduct of C., a sole practitioner since 2002, carrying on a family law practice, performing matters such as real estate transactions. The panel met on one citation regarding a breach of a trust condition. C. did not contest the submission of counsel that this conduct was conduct deserving of sanction. During the hearing, the panel considered that C. had no record, it was unlikely C.'s misconduct would be repeated, and C. acknowledged the misconduct in his/her initial dealings with the LSA. |

The entire process had affected C. so significantly that C. sought counseling. The panel concluded a fine was unnecessary to achieve specific deterrence. In the report, the panel wrote that "the panel was equally convinced that in all the circumstances the objectives of general deterrence, and of maintaining public confidence would be met by the sanction of a reprimand upon C. together with a requirement to pay the actual costs of the hearing (est. at under $1,800). |
