New Trust Accounting Controls to be Phased In

Approval of the Law Society of Alberta Benchers is being sought at the upcoming April 2010 meetings to approve the implementation of a new controls and audit structure to protect the safety of trust funds.

It is expected that implementation will be phased-in, beginning in May 2010.

The recommendations made by the Law Society of Alberta's Security of Trust Funds Implementation Task Force will result in changes to the trust accounting rules and the Law Society's audit strategy.

Detailed communications to lawyers is being prepared and will be provided to lawyers once the Benchers have approved the new structure. The Law Society of Alberta will be communicating directly to firms initially involved to assist in the transition.

The new regulatory structure for safety of trust property will address concerns about rising threats to the security of trust funds, for the protection of the public interest as well as the profession.

Work Continues on Access to Legal Services

A new Access Steering Committee with leadership from the Law Society, Alberta Justice, the Courts, CBA and Legal Aid Alberta is considering both alternative delivery of legal services work and initiatives around unbundling or discrete retainers.
